DWI defense requires extensive knowledge of the area--statutes, decisional law and the scientific bases of testing as well as outstanding trial skills. NCDAA is well known for presenting excellent, thorough DWI defense programs. These seminars provide complete information for the practitioner in all areas of representation. This year's seminar will again be chaired by two highly experienced DWI defense attorneys, NCDAA Board Member Russ Jones of North Platte and NCDAA Past President Brad Roth of Lincoln.

SPEAKERS

NCDAA is pleased to be able to announce that Fleming Whited, III of Daytona Beach, Florida will be returning to Nebraska to present at the NCDAA seminar. Mr. Whited’s credentials are many; he is clearly one of the best DWI defense attorneys in the nation. He is the author of DUI Defense-Florida, Revere Legal Publishers. He co-authored Drinking/Driving Litigation (four volumes supplemented three times annually) and he writes the Drinking/Driving Law Letter (bi-monthly newsletter), all West Group Publications. They continue to be the most comprehensive and authoritative works covering alcohol related issues in the United States. He is one of the founders and a former Dean of the National College for DUI Defense. He has lectured on DUI issues in over 150 seminars in more than 25 states, including every NACDL DUI program, 18 of the 20 Minnesota Society for Criminal Justice National Seminars and 6 of the National College for DUI Defense multi-day programs in Boston. The Orlando Sentinel’s Florida Magazine branded him “The Drunken Drivers Best Friend”. His clients have included lawyers, police officers, political figures, pro athletes, entertainers and just plain folks.

The seminar will also feature Phillip Price of Huntsville, Alabama, another nationally known DWI defense lawyer. He is considered one of the foremost authorities on breath test issues and lectures extensively. He, too, is a former dean of the National DUI Defense College.

Judge Daniel Bryan of Auburn will provide his insights on "Effective Motions to Suppress." Prior to becoming a District Judge, Judge Bryan spent numerous years on the county bench. His outstanding knowledge in this area recognized across the state.

Bruce Kapsack of Oakland, California is an expert in field sobriety testing and how best to challenge it. He is both an attorney and a certified field sobriety test instructor. NCDAA Board Member Bell Island of Scottsbluff has participated in a field sobriety training course and will provide his perspective along with other suggestions for successfully dealing with some of the legal issues concerning field sobriety testing in Nebraska.

Nationally known jury consultant Jill Holmquist of Lincoln will educate on jury selection in DWI cases. She teaches at Nebraska Wesleyan University and has worked on jury selection across the county.

Recent developments in DWI defense will be provided by attorneys Matt Kosmicki and Jeff Kirkpatrick of Lincoln and interlock provider Jerry Stanton of Grimes, Iowa. This presentation will bring everyone current on recent developments of interest in caselaw, legislation and with interlocks.

Probation officials Steve Rowoldt and Deb Minardi of Lincoln will discuss the new standards for certification for drug and alcohol evaluation programs which have been mandated by the courts.

LOCATION

The seminar will be held at Eugene T. Mahoney State Park in Ashland, approximately half way between Lincoln and Omaha. Mahoney Park is located directly north of Interstate 80 at Exit 426. It is a large, beautiful park adjacent to the Platte River and offers many recreational activities. The seminar will be held on the second floor of the main lodge building. A valid state park entry permit is required. The park has a variety of accommodations, including lodge rooms, cabins and camping facilities.
