The Attorney General's office has moved a number of bills through the Legislature this year that will among other changes, dramatically increase penalties for some crimes and broaden the sex registration act. An example of this is LB 63. The committee statement of the bill can be viewed on the Nebraska legislature website, www.nebraskalegislature.gov. We sent a letter of opposition to this bill due to the potential for increased costs as a result of increased penalties. Dennis Keefe drafted the letter. Probably, the most onerous aspect of this bill is the repeal of the "snitch statutes". The Nebraska Criminal Defense Attorney's Association became involved early on in changing the bill. Senator Lathrop solicited our input through Tom Riley. Senator Lathrop tried to salvage the "snitch statutes" by placing some of the provisions in discovery statutes. However, the definition of jailhouse witness has been changed to mean a person in the physical custody of any jail or correctional institution.

This has been a difficult year. I will be reporting about other AG bills as they pass.

I believe it is time for the Criminal Defense Attorney's Association to examine new strategies to combat these sorts of bills. Senator Lathrop has offered to speak to the Board and/or Legislative Committee to talk about effective ways to shape legislation. If the Board and/ or legislative committee decides that his offer to speak would be helpful, I believe that the meeting should occur as soon as possible after the legislature adjourns.
